These terms set clear expectations for buyers, vendors, and visitors using YSmarket. By creating an account or using marketplace services, you agree to them.

YSmarket's role

YSmarket provides technology for discovering products, connecting buyers with independent vendors, recording orders, submitting payment evidence, tracking fulfilment, and administering marketplace protection and payouts.

Unless a listing expressly says otherwise, the vendor is the seller of the product. YSmarket is not a bank, lender, deposit-taking institution, Safaricom, or an M-Pesa affiliate. Payment services remain subject to the terms of the external payment provider.

Buyer responsibilities

  • Provide accurate account, phone, delivery, and payment-evidence information.
  • Check the product, variant, condition, price, delivery estimate, and seller terms before ordering.
  • Pay only through the instructions displayed by YSmarket and submit authentic evidence for your own transaction.
  • Respond reasonably to delivery, verification, cancellation, and dispute requests.
  • Do not misuse refunds, reviews, reports, promotions, or buyer-protection processes.

Vendor responsibilities

  • Complete the vendor review process and keep business, contact, fulfilment, and payout information current.
  • List only products you are authorized to sell, with accurate media, condition, price, variants, inventory, delivery terms, and policies.
  • Prepare, dispatch, and update accepted orders within the stated timeline.
  • Package products safely, cooperate with legitimate returns or disputes, and maintain records needed for reconciliation.
  • Pay applicable marketplace fees and avoid directing YSmarket buyers around marketplace protections.

Listings and marketplace content

Listings must not be misleading, unlawful, counterfeit, unsafe, stolen, discriminatory, or infringe another person's rights. YSmarket may review, limit, correct, unpublish, or remove content that creates marketplace risk or violates these terms.

You retain ownership of content you submit. You grant YSmarket a non-exclusive, worldwide license to host, reproduce, resize, display, distribute, and promote that content only as needed to operate and market the marketplace. You confirm that you have the rights needed to grant this license.

Payments and verification

Prices and fees are displayed in Kenyan shillings unless stated otherwise. A submitted M-Pesa message or transaction code is evidence for verification; it is not by itself confirmation that YSmarket received or approved payment. Duplicate, altered, mismatched, or unverifiable evidence may be rejected and investigated.

An order becomes eligible for fulfilment after the required payment and verification steps are complete. You must not submit another person's transaction code or reuse a transaction code across orders.

Order, escrow, and payout lifecycle

YSmarket may record verified order funds as protected or held while fulfilment, delivery, cancellation, refund, or dispute conditions remain unresolved. These operational records are marketplace safeguards and are not bank accounts offered to users.

Vendor balances become eligible for payout according to the order status, delivery evidence, applicable return or dispute window, marketplace fees, deductions, and payout review. YSmarket may pause reconciliation or payout where fraud, duplicate evidence, chargeback, legal, or account-risk concerns exist.

Delivery, cancellations, and disputes

Delivery dates are estimates unless expressly guaranteed. Buyers and vendors must provide reasonable cooperation for fulfilment. Cancellation and refund eligibility depends on order status, product condition, seller terms, marketplace rules, and applicable Kenyan consumer law.

Raise a problem promptly through YSmarket support and preserve relevant messages, images, packaging, and delivery evidence. We may request information from both parties and take a proportionate resolution action, including rejecting a claim, cancelling an order, refunding an eligible amount, or adjusting a vendor payout.

Prohibited conduct

You must not impersonate others, manipulate marketplace metrics, scrape or attack the service, evade fees, compromise accounts, submit malicious content, harass users, exploit promotions, falsify payment or delivery evidence, launder funds, or use YSmarket for unlawful activity.

Account enforcement

YSmarket may warn, restrict, suspend, or close accounts; remove content; hold risky transactions for review; or report suspected unlawful activity where reasonably necessary to protect users, comply with law, or enforce these terms. Where appropriate, we will explain the action and provide a support path.

Service and liability boundaries

We work to keep YSmarket accurate and available, but marketplace listings, vendor conduct, network availability, delivery services, and external payment systems can fail or change. To the extent permitted by Kenyan law, YSmarket is not liable for indirect or consequential loss that was not reasonably foreseeable.

Nothing in these terms excludes rights or liability that cannot lawfully be excluded, including applicable consumer protections.

Changes, Kenyan law, and contact

We may update these terms as the marketplace develops. Material changes will be communicated reasonably, and continued use after the effective date means the updated terms apply. These terms are governed by the laws of Kenya, and disputes are subject to the competent courts of Kenya unless mandatory law provides otherwise.
